1. Responsibilities of the Lessee:
1.1 The Lessee, hereby referred to as the Hirer, accepts complete responsibility for all users of the equipment during the rental period.
1.2 The Hirer agrees to inspect the rental items listed above for any pre-existing damage and ensure the functionality of the equipment before use.
1.3 The Hirer must exercise due care and diligence in handling the rented equipment to prevent any loss or damage during the rental period.
1.4 It is the responsibility of the Hirer to return all rented equipment by the specified due date and time. Failure to do so may result in late charges as outlined in this agreement.
1.5 In the event of any loss or damage to the rented equipment, or if the Hirer is unable to return the equipment by the due date, the Company must be notified immediately.
2. Proper Use of Equipment:
2.1 The Hirer agrees to use the rented equipment in accordance with the Company’s instructions and for its intended purpose only.
2.2 Any deviation from the manufacturer’s instructions, misuse, or allowing the equipment out of the Hirer’s control and possession shall be considered improper use.
2.3 The Hirer acknowledges that improper use includes, but is not limited to, neglecting to protect the equipment from damage, using it in hazardous conditions, or using it in a manner inconsistent with its design.
3. Liability and Indemnification:
3.1 The Hirer accepts full liability for any loss or damage caused to the equipment due to negligence or improper use during the rental period.
3.2 The Hirer agrees to pay for the cost of replacement or repair of the rented equipment up to its retail price, in the event of damage or loss resulting from their negligence or improper use.
3.3 The Company shall not be held liable for any injury, loss, or damage, whether direct or consequential, arising from the use or improper use of the rented equipment.
4. Applicable Law:
4.1 This contract shall be governed by the laws of the State of Queensland and any applicable Federal Law.
These terms and conditions aim to clarify the responsibilities of both parties and provide better protection for the rental company while ensuring transparency and fairness for the hirer.
